By accessing and using PikePixel's services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

3. Payment Terms

Payment is structured as follows:

• 50% deposit required before project work begins
• Remaining 50% due when the website goes live

We accept major credit cards and other payment methods as agreed upon. All pricing is subject to change without notice.

Package features, pricing, and terms are as stated at the time of purchase and may vary for future clients. Service inclusions (such as hosting duration, domain registration periods, and email hosting) are subject to the specific terms agreed upon in your project contract.

4. Client Responsibilities

You are responsible for:

• Providing accurate and complete project information
• Supplying necessary content, images, logos, and materials
• Timely feedback and approval at each project stage
• Ensuring you have legal rights to all materials you provide (including but not limited to images, videos, text, logos, and other intellectual property)
• Maintaining the security of your website and hosting credentials

5. Intellectual Property

Upon full payment, you will own the rights to your website design and content. However, PikePixel retains the right to:

• Display your website in our portfolio
• Use your project as a case study
• Reference your business as a client

Client IP Responsibility: You are solely responsible for ensuring that all content, images, videos, text, logos, and other intellectual property you provide to PikePixel are either owned by you or properly licensed for use. You warrant that your use of such materials does not infringe upon any third-party rights.

PikePixel is not liable for any copyright infringement, trademark violation, or other intellectual property disputes arising from materials provided by the client. You agree to indemnify and hold PikePixel harmless from any claims, damages, or legal actions resulting from your use of unlicensed or infringing materials.

6. Cancellation and Refunds

Projects may be cancelled before work begins for a full refund of the initial deposit. Once design work has commenced, refunds will be prorated based on work completed. No refunds are available once the final website has been delivered and approved, and the final payment has been made.

7. Limitation of Liability

PikePixel is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for the service in question. We are not responsible for any losses, damages, or legal issues arising from downtime, service interruptions, or content provided by the client.

8. Termination

We reserve the right to terminate services for violation of these terms, illegal activities, or non-payment. Upon termination, you will have 30 days to migrate your website to another provider, if applicable.

9. Changes to Terms and Services

We reserve the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.

PikePixel reserves the right to modify package offerings, pricing, service inclusions, and terms at any time without prior notice. Changes will not affect existing contracts or purchased services, but will apply to new clients and future purchases.
